2. Prices

All prices displayed on the website are shown in the applicable currency and include VAT where required by law, unless otherwise stated.

Prices may be displayed in different currencies depending on your selected region or preferences. It is the customer's responsibility to verify the currency selected before completing an order.

Any applicable import duties, customs fees, local taxes, or other charges imposed by authorities in the destination country are the responsibility of the customer unless otherwise stated.

3. Payment

We currently accept payment by bank transfer.

Payment terms:

• 50% deposit upon order confirmation
• Remaining 50% payable prior to shipment or collection

An invoice containing payment instructions will be issued once your order has been processed.

4. Delivery

Standard production and delivery time is approximately 6 weeks.

During peak seasons, delivery times may extend to up to 8 weeks. If the expected delivery date for your order differs significantly from these estimates, we will notify you as soon as possible.

Shipping costs are calculated and displayed during the ordering process.

Customers may choose between:

• Collection from one of our designated collection points
• Shipment to the delivery address specified in the order

5. Transfer of Risk

Risk of loss or damage to the goods passes to the customer upon delivery.

6. Warranty and Defective Products

Consumers are entitled to remedies for goods that are defective or not in conformity with the contract in accordance with applicable consumer protection legislation. Such rights may include repair, replacement, price reduction, or reimbursement, depending on the circumstances and applicable law.

The warranty does not cover defects, damage, or deterioration resulting from misuse, improper installation, inadequate maintenance, normal wear and tear, accidents, or unauthorized modifications.

Any claim regarding defects should be submitted within a reasonable period after the defect has been discovered.

If return of the product is required, we will provide instructions. We do not accept returns sent cash on delivery (COD) or similar arrangements.

7. Right of Withdrawal and Returns

Consumers may cancel the purchase of non-customized products within 14 days of receiving the goods, where such right is provided under applicable consumer protection legislation.

The withdrawal period expires 14 days after the day on which the customer, or a third party designated by the customer, receives the goods.

For orders consisting of multiple shipments, the withdrawal period begins when the final item is received.

To exercise the right of withdrawal, you must notify us by email at info@leansails.com.

Refusing delivery or failing to collect a shipment does not in itself constitute a valid cancellation.

Returned products must be sent back without undue delay and no later than 14 days after notifying us of the cancellation.

Unless otherwise required by law, the customer is responsible for the direct costs of returning the goods.

The customer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functionality of the product.

8. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to goods manufactured according to the customer's specifications or clearly personalized products, including but not limited to custom-made sails, covers, and similar bespoke products.

9. Refunds

If a purchase is validly cancelled, all payments received from the customer will be refunded, including standard delivery charges where required by applicable law.

Any additional costs resulting from the customer's choice of a delivery method other than the least expensive standard option offered by us will not be refunded.

Refunds will be processed without undue delay and no later than 14 days after we receive notice of the cancellation.

We may withhold reimbursement until we have received the returned goods or proof that the goods have been returned, whichever occurs first.

Refunds will be made using the same payment method used for the original transaction, unless otherwise agreed.

10. Customs, Duties and Taxes

For orders delivered within the European Union, VAT will be charged in accordance with applicable EU regulations.

For deliveries to countries outside the European Union, additional customs duties, import taxes, brokerage fees, or other charges may apply. Such charges are imposed by the destination country's authorities and are the sole responsibility of the customer.

LeanSails ApS has no control over these charges and cannot predict their amount. Customers are advised to contact their local customs authority for further information before placing an order.

If a shipment is refused by the customer due to customs duties, taxes, or import-related charges, LeanSails ApS reserves the right to deduct any costs incurred, including shipping, return shipping, customs handling fees, and administrative costs, from any refund due.

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Denmark.

If you are a consumer residing in another EU Member State, you will also benefit from any mandatory provisions of consumer protection law applicable in your country of residence. Nothing in these Terms and Conditions shall affect your statutory rights under applicable consumer protection legislation.

Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the jurisdiction of the competent courts of Denmark, unless otherwise required by mandatory consumer protection laws.

12. Complaints and Dispute Resolution

If you have any complaint regarding your purchase, please contact us at info@leansails.com. We will make reasonable efforts to resolve the matter amicably.

For consumers residing within the European Union, additional rights and dispute resolution mechanisms may be available under applicable local consumer protection laws.

Nothing in these Terms and Conditions limits any statutory rights that consumers may have under applicable law.

13. Country-specific provisions

The terms above apply to all Lean Sails customers. Where the mandatory consumer law of your country requires different provisions, the country-specific terms below apply to your country and prevail over the general terms.
